IMAST Operations Private Limited respects the intellectual property rights of others and expects its users to do the same. This page outlines our process for handling IPR infringement complaints related to content or activity on the IMAST 360 platform.

What Constitutes IPR Infringement
Intellectual property infringement occurs when copyrighted material, trademarks, patents, or trade secrets are used without authorization from the rights holder. Examples include, but are not limited to:
- Uploading or distributing copyrighted content (text, images, software, data) through IMAST services without permission
- Using another party's trademark or brand identity in a manner that causes confusion or implies false endorsement
- Replicating patented processes or methods within applications built on the IMAST platform
- Misappropriating trade secrets or proprietary business data belonging to another party
How to File a Complaint
If you believe that your intellectual property rights have been infringed by content or activity on the IMAST 360 platform, please submit a written complaint to legal@imast.in with the following information:
- Your contact information: Full name, organization, email address, phone number, and mailing address.
- Description of the protected work: A clear description of the copyrighted work, trademark, or other intellectual property you claim has been infringed.
- Proof of ownership: Documentation establishing your ownership or authorization to act on behalf of the rights holder (e.g., registration certificates, authorization letters).
- Identification of infringing material: A specific description of where the allegedly infringing material is located on the IMAST platform, with sufficient detail for us to locate it.
- Statement of good faith: A statement that you have a good faith belief that the use is not authorized by the rights holder, its agent, or the law.
- Declaration of accuracy: A statement, made under penalty of perjury, that the information in the complaint is accurate and that you are the rights holder or authorized to act on their behalf.
IMAST's Response Process
Upon receiving a valid IPR complaint, IMAST will follow this process:
- Acknowledgment: We will acknowledge receipt of your complaint within 48 hours.
- Review: Our legal team will review the complaint for completeness and validity.
- Investigation: We will investigate the claim and, if necessary, contact the alleged infringer within 14 days.
- Action: If the complaint is substantiated, IMAST will take appropriate action, which may include removing the infringing content, disabling access, or suspending the offending account.
- Notification: Both the complainant and the alleged infringer will be notified of the outcome.
Counter-Notification Process
If you are an IMAST user and believe that content removed or disabled as a result of an IPR complaint was removed in error, you may submit a counter-notification to legal@imast.in including:
- Your contact information
- Identification of the material that was removed and its prior location
- A statement under penalty of perjury that you have a good faith belief the material was removed by mistake or misidentification
- Consent to the jurisdiction of the courts in Indore, Madhya Pradesh, India
IMAST will review counter-notifications and may restore the content if the original complainant does not pursue legal action within 14 business days.
